1. Agreement
These Terms of Service (the "Terms") form a binding agreement between KYO Online Services Ltd, a company registered in the United Kingdom ("we", "us", "BETALL"), and the organization or individual accessing BETALL.APP (the "Customer", "you").
By creating an account, starting a free trial, or otherwise using the platform, you confirm that you have read, understood and agree to be bound by these Terms.
2. The service
BETALL.APP is a cloud-based B2B CRM that provides contact and account management, SMS messaging with live HLR verification, analytics, integrations and related features, delivered as software-as-a-service.
We may add, modify or remove features over time. We will not materially reduce the core functionality of a paid plan during a billing period without notice.
3. Accounts & free trial
New accounts are subject to manual review and approval to maintain a high-quality customer base. We may approve, decline or revoke access at our discretion where there is a legitimate reason to do so.
The free trial lasts 30 calendar days from activation, grants Business-plan features, and requires no credit card. Trial limits apply (contacts, SMS volume and users). At the end of the trial the account becomes read-only for 14 days before archival, unless a paid plan is activated.
4. Acceptable use
You agree not to use the platform to:
- send unsolicited messages (spam) or violate any applicable anti-spam, telecoms or marketing law
- upload unlawful, infringing or harmful content
- attempt to gain unauthorized access to the platform or other tenants’ data
- reverse engineer, resell or sublicense the service except as permitted in writing
5. SMS, HLR & messaging
SMS sending consumes credits. Before each send we perform a live HLR lookup; messages to numbers returned as invalid are blocked and not charged. You are responsible for obtaining valid consent from recipients and honoring opt-outs.
6. Fees & billing
Paid plans are billed in euros (EUR) in advance on a monthly or annual basis via our payment processor. Except where required by law, fees are non-refundable. Add-ons such as additional SMS credits are billed as consumed or purchased.
7. Data protection
Each party will comply with applicable data protection law. Where we process personal data on your behalf, we act as processor and you as controller, governed by our Data Processing Agreement, which is incorporated into these Terms by reference.
8. Availability & support
We target high availability and operate redundant infrastructure in the EU, but the service is provided "as available". Planned maintenance will be communicated in advance where practical.
9. Liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss. Our aggregate liability in any 12-month period is limited to the fees paid by you for that period. Nothing limits liability that cannot be excluded by law.
10. Termination
You may cancel at any time from your account. We may suspend or terminate access for material breach. On termination you may export your data for 30 days, after which it is deleted in line with our retention policy.
11. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
